Art. 15 Konzessionsvoraussetzungen

Wer eine Grundversorgungskonzession erwerben will, muss:

a.: über die notwendigen technischen Fähigkeiten verfügen;
b.⁴⁸: glaubhaft darlegen, dass das Dienstleistungsangebot, insbesondere in finanzieller Hinsicht, und der Betrieb während der ganzen Konzessionsdauer
sichergestellt sind, und ausweisen, welche finanzielle Abgeltung nach Artikel 19 dafür beansprucht wird;
c.: dafür Gewähr bieten, dass er das anwendbare Recht, namentlich dieses Gesetz, seine Ausführungsbestimmungen sowie die Konzession einhält;
d.⁴⁹: dafür Gewähr bieten, dass er die arbeitsrechtlichen Vorschriften einhält und die Arbeitsbedingungen der Branche gewährleistet.

Art. 15 Conditions for granting the licence

Any person wishing to obtain a universal service licence must:

a.: have the necessary technical capacities;
b.⁴⁸: furnish convincing proof that the service can be offered, particularly with regard to finance, and the service operated for the entire duration of the licence, and state what financial compensation, in accordance with Article 19, will be required;
c.: undertake to comply with the applicable legislation, in particular this Act and its implementing provisions, and the licence conditions;
d.⁴⁹: undertake to comply with employment legislation and to guarantee the working conditions that are customary in the sector.
