Art. 24

1 Die Kantone sorgen für die Aufsicht über die berufliche Grundbildung.

2 Zur Aufsicht gehören die Beratung und Begleitung der Lehrvertragsparteien und die Koordination zwischen den an der beruflichen Grundbildung Beteiligten.

3 Gegenstand der Aufsicht sind darüber hinaus insbesondere:

a.
die Qualität der Bildung in beruflicher Praxis, einschliesslich der überbetrieblichen Kurse und vergleichbarer dritter Lernorte;
b.
die Qualität der schulischen Bildung;
c.
die Prüfungen und andere Qualifikationsverfahren;
d.
die Einhaltung der gesetzlichen Bestimmungen im Lehrvertrag;
e.
die Einhaltung des Lehrvertrags durch die Vertragsparteien.

4 Der Kanton entscheidet auf gemeinsamen Antrag der Anbieter der Berufsbildung und der Lernenden über:

a.
die Gleichwertigkeit nicht formalisierter Bildungen nach Artikel 17 Absatz 5;
b.
Fälle nach Artikel 18 Absatz 1.

5 Die Kantone können im Rahmen ihrer Aufsicht insbesondere:

a.
weitergeleitete Beiträge nach Artikel 52 Absatz 2 zweiter Satz ganz oder teilweise zurückfordern;
b.
einen Lehrvertrag aufheben.

Art. 24

1 The Cantons shall be responsible for overall supervision of VET programmes.

2 Supervisory activities shall comprise the provision of guidance and suggestions to parties to the apprenticeship contract as well as overall coordination between the VET participants.

3 Supervisory activities shall also include the following:

a.
ensuring the quality of workplace training, including branch courses or similar third-party training courses;
b.
ensuring the quality of the classroom instruction segment of VET programmes;
c.
monitoring examinations and other qualification procedures;
d.
ensuring that apprenticeship contracts are in line with statutory provisions;
e.
ensuring that contracting parties abide by the terms of their apprenticeship contracts.

4 If a joint request is made by education and training providers and the learners, the Cantons shall decide on the following matters:

a.
validation of non-formal learning under Article 17 paragraph 5;
b.
cases referred to in Article 18 paragraph 1.

5 Within the framework of their supervisory activities, the Cantons may:

a.
claim back all or part of the federal funding given to the third parties referred to in Article 52 paragraph 2 sentence 2;
b.
terminate an apprenticeship contract.
