Art. 50

Ausländische Entscheidungen oder Massnahmen über die ehelichen Rechte und Pflichten werden in der Schweiz anerkannt, wenn sie:

a.
im Staat des Wohnsitzes oder des gewöhnlichen Aufenthalts eines der Ehegatten ergangen sind; oder
b.
im Staat der Eheschliessung ergangen sind und es unmöglich oder unzumutbar war, die Klage in einem der in Buchstabe a bezeichneten Staaten zu erheben.

Art. 50

Foreign decisions or measures relating to the effects of marriage are recognised in Switzerland if they were rendered:

a.
in the state of domicile or habitual residence of either spouse; or
b.
in the state in which the marriage was celebrated and the action cannot or cannot reasonably be expected to be brought in either of the states mentioned in letter a.
