Art. 20 Form und Inhalt des Widerspruchs

Der Widerspruch ist in zwei Exemplaren einzureichen und muss enthalten:

a.46
den Namen und Vornamen oder die Firma, die Adresse des Widersprechenden und gegebenenfalls sein Zustellungsdomizil in der Schweiz;
b.
die Registernummer der Markeneintragung oder die Gesuchsnummer der Markenhinterlegung, auf die sich der Widerspruch stützt;
c.
die Registernummer der angefochtenen Markeneintragung sowie den Namen oder die Firma des Markeninhabers;
d.
die Erklärung, in welchem Umfang gegen die Eintragung Widerspruch erhoben wird;
e.
eine kurze Begründung des Widerspruchs.

Art. 20 Form and content of the opposition

The opposition must be submitted in two copies and must include:

a.46
the surname and first name or the company name, the address of the opposing party and, if applicable, their address for service in Switzerland;
b.
the number of the trade mark registration or the application number of the filed trade mark on which the opposition is based;
c.
the number of the disputed trade mark registration as well as the name or company name of the proprietor of the trade mark;
d.
a declaration of the extent of the opposition to the registration;
e.
a short statement of reasons for the opposition.
