Art. 35

Das IGE löscht eine Markeneintragung ganz oder teilweise; wenn:

a.
der Inhaber die Löschung beantragt;
b.
die Eintragung nicht verlängert wird;
c.
die Eintragung durch ein rechtskräftiges richterliches Urteil nichtig erklärt wird;
d.29
die geschützte Ursprungsbezeichnung oder die geschützte geografische Angabe, auf die sich eine geografische Marke stützt, gelöscht wird;
e.30
ein Antrag auf Löschung gutgeheissen wird.

Art. 35

The IPI shall cancel a trade mark registration in whole or in part if:

a.
the proprietor requests the cancellation;
b.
the registration has not been renewed;
c.
the registration has been declared null and void in a final court decision;
d.29
the protected appellation of origin or the protected geographical indication on which the geographical mark is based is cancelled;
e.30
a request for cancellation is approved.
