514.54 Federal Act of 20 June 1997 on Weapons, Weapon Accessories and Ammunition (Weapons Act, WA)

Art. 42 Disposiziun transitorica

1 Tgi che dastga – tenor il dretg chantunal vertent – purtar in’arma u far commerzi cun armas e vul tegnair quest dretg, sto inoltrar entaifer 1 onn suenter l’entrada en vigur da questa lescha ina dumonda per la permissiun correspundenta.

2 Il dretg resta garantì, fin ch’ina decisiun davart la dumonda è vegnida prendida.

3 Las permissiuns d’import, d’export e da transit tenor la Lescha dals 30 da zercladur 1972168 e dals 13 da december 1996169 davart il material da guerra mantegnan lur valaivladad.

4 Tgi che ha tenor il dretg vertent ina permissiun per l’import, per l’export e per il transit d’armas, da parts essenzialas d’armas, da muniziun e d’elements da muniziun a titel professiunal, dastga vinavant apportar en il territori svizzer u exportar quests objects sin basa da questa permissiun.170

5 Tgi che posseda gia armas, parts essenzialas d’armas u parts d’armas construidas spezialmain tenor l’artitgel 5 alinea 2 u accessoris d’armas tenor l’artitgel 5 alinea 1 litera g, sto annunziar quests objects entaifer 3 mais suenter l’entrada en vigur da questa disposiziun a las autoritads chantunalas ch’èn cumpetentas per conceder permissiuns excepziunalas.171

6 Entaifer 6 mais suenter l’entrada en vigur dal scumond tenor l’artitgel 5 alinea 2 po vegnir inoltrada ina dumonda per ina permissiun excepziunala. Exceptà da questa disposiziun è, tgi che ha gia ina permissiun excepziunala valaivla per acquistar l’arma. Tgi che na vul betg inoltrar ina dumonda, sto transferir ils objects entaifer 6 mais suenter l’entrada en vigur dal scumond ad ina persuna autorisada.172

7 Sche la dumonda per ina permissiun excepziunala vegn refusada, ston ils objects vegnir transferids entaifer 4 mais suenter la refusa ad ina persuna autorisada.173

Art. 42 Transitional provision

1 Any person who is permitted to carry a weapon or trade in weapons under existing cantonal law and wishes to retain this right must apply for the appropriate permit within one year of this Act coming into force.

2 The right remains in force until a decision is reached on the application.

3 Import, export and transit permits under the War Materials Act of 30 June 1972168 and 13 December 1996169 retain their validity.

4 Any person who under existing law has a permit for the commercial import, export or transit of weapons, essential weapon components, ammunition and ammunition components may continue to bring these objects into Switzerland or export them on the basis of this permit.170

5 Any person who is already in possession of weapons, essential or specially designed weapon components in accordance with Article 5 paragraph 2, or weapon accessories in accordance with Article 5 paragraph 1 letter g must register them with the cantonal authorities responsible for issuing exemption permits within three months of this provision coming into force.171

6 An application for an exemption permit may be submitted within six months of the ban under Article 5 paragraph 2 coming into force. Any person who already has a valid exemption permit for acquiring weapons is exempt from this provision. Any person who does not wish to submit an application, must transfer possession of the objects to an authorised person within six months of the ban coming into force.172

7 If the application for an exemption permit is rejected, the objects must be transferred to the possession of an authorised person within four months of the application being rejected.173
