514.54 Federal Act of 20 June 1997 on Weapons, Weapon Accessories and Ammunition (Weapons Act, WA)

Art. 27 Purtar armas

1 Tgi che vul purtar in’arma en lieus accessibels a la publicitad u transportar in’arma, dovra ina permissiun per purtar in’arma. Questa permissiun ston ins avair cun sai ed ella sto vegnir mussada, sch’ils organs da polizia u da duana pretendan quai. Resalvà resta l’artitgel 28 alinea 1.

2 Ina permissiun per purtar in’arma survegn ina persuna:

a.
sch’i n’exista per ella nagin motiv d’impediment tenor l’artitgel 8 alinea 2;
b.
sch’ella fa valair vardaivlamain ch’ella dovra in’arma per proteger sasezza u autras persunas u chaussas cunter ina periclitaziun reala;
c.
sch’ella ha reussì in examen che attesta ch’ella sappia ir enturn cun armas e ch’ella haja enconuschientscha da las premissas giuridicas dal diever da l’arma; il Departament federal da giustia e polizia decretescha in reglament d’examen.

3 La permissiun vegn concedida da l’autoritad cumpetenta dal chantun da domicil per in tschert gener d’arma e per maximalmain 5 onns. Ella vala per tut la Svizra e po esser colliada cun cundiziuns. Persunas che abitan a l’exteriur survegnan la permissiun da l’autoritad cumpetenta dal chantun, en il qual ellas fan quint d’entrar en Svizra.

4 Nagina permissiun na dovran:

a.
titulars d’ina patenta da chatscha, survegliaders da chatscha e guardiaselvaschinas per las armas ch’els portan exequind lur activitad;
b.
participants ad occurrenzas, a las qualas vegnan purtadas armas en connex cun eveniments istorics;
c.
participants ad occurrenzas da tir cun armas da soft air che han lieu sin in territori segirà, per purtar talas armas;

incumbensads esters da la segirezza aviatica sin il territori da las plazzas aviaticas svizras, premess che l’autoritad estra ch’è cumpetenta per la segirezza en il traffic aviatic disponia d’ina permissiun generala tenor l’artitgel 27a;

collavuraturs d’autoritads estras da guardia da cunfin che lavuran en Svizra ensemen cun collavuraturs da las autoritads svizras da guardia da cunfin tar acziuns operativas als cunfins exteriurs dal territori da Schengen.

Art. 27 Carrying a weapon

1 Any person who carries a weapon in publicly accessible places or who wishes to transport a weapon requires a permit to carry a weapon. The permit must be carried at all times and presented to the police or customs authorities on request. Article 28 paragraph 1 remains without prejudice.

2 A person is granted a permit to carry a weapon if:

a.
they are not subject to any of the restrictions under Article 8 paragraph 2;
b.
they can plausibly justify that they require a weapon to protect themselves, other persons or things from genuine danger;
c.
they have passed a test on handling weapons and on knowledge of the legal requirements for using weapons; the Federal Department of Justice and Police issues examination regulations.

3 The permit is issued by the competent authority of the canton of residence for a specific type of weapon and for a maximum of five years. It is valid throughout Switzerland and may be subject to conditions. Persons resident abroad obtain the permit from the competent authority of the canton where they enter Switzerland.

4 A permit is not required by:

a.
holders of a hunting permit, hunting inspectors and gamekeepers for carrying weapons while exercising their duties;
b.
participants of events at which weapons are carried in connection with historic events;
c.
participants of shooting events involving airsoft weapons carrying these weapons on secured terrain;
d.
foreign aviation security officers on the territory of Swiss airports, providing the foreign authority responsible for air traffic safety has a general permit in accordance with Article 27a;
e.95
members of foreign border protection authorities who together with members of the Swiss border guard authorities are involved in operations at the external borders of the Schengen area in Switzerland.

5 The Federal Council regulates the details on issuing permits to carry a weapon, especially on issuing permits to foreign members of staff at diplomatic missions, permanent missions of international organisations, consular posts and special missions.
