1 La direzione del fondo non può delegare la direzione del fondo di investimento a terzi. Può tuttavia delegare a terzi le decisioni di investimento e altri compiti parziali, sempre che tale delega sia nell’interesse di una gestione adeguata.
2 Le decisioni di investimento concernenti investimenti collettivi di capitale le cui quote sono offerte in modo agevolato nell’Unione europea in virtù di un accordo non possono essere delegate né alla banca depositaria né ad altre imprese i cui interessi possano collidere con quelli del gestore di patrimoni collettivi, della direzione del fondo o degli investitori.
1 The fund management company may not delegate the management of the investment fund to third parties. However, it may delegate investment decisions as well as specific tasks to third parties, provided this is in the interests of efficient management.
2 In the case of collective investment schemes for which the facilitated offering of shares exists in the European Union based on a treaty, investment decisions may not be delegated to either the custodian bank or any other companies whose interests may conflict with those of the manager of collective assets or the fund management company or the investors.
