951.311 Ordinance of 22 November 2006 on Collective Investment Schemes (Collective Investment Schemes Ordinance, CISO)
Art. 1a Club di investimento
(art. 2 cpv. 2 lett. f LICol)
A prescindere dalla sua forma giuridica, un club di investimento deve adempiere le seguenti condizioni:
- a.
- i diritti dei soci devono essere indicati nel documento costitutivo determinante per la forma giuridica prescelta;
- b.
- i soci o una parte di essi adottano le decisioni di investimento;
- c.
- i soci sono regolarmente informati sullo stato degli investimenti;
- d.
- il numero di soci non deve superare le 20 persone.
Art. 1a Investment club
(Art. 2 para. 2 let. f CISA)
Irrespective of its legal status, an investment club must meet the following requirements:
- a.
- The membership rights are set out in the relevant constitutive document for its chosen legal status.
- b.
- The members or a section of the members take the investment decisions.
- c.
- The members are informed about the status of the investments on a regular basis.
- d.
- The number of members does not exceed twenty.
