(art. 126 cpv. 1 e 6 LICol)
1 La società di audit della banca depositaria deve indicare in un rapporto di audit separato se quest’ultima rispetta la legislazione sulla vigilanza e le disposizioni contrattuali.
2 Deve inoltre includere le irregolarità eventualmente rilevate nel rapporto di audit della banca depositaria secondo l’articolo 27 capoverso 1 della legge del 22 giugno 2007212 sulla vigilanza dei mercati finanziari.
3 Deve presentare il rapporto di audit secondo il capoverso 1 ai seguenti destinatari:
4 La società di audit della direzione del fondo o della SICAV deve tener conto, nell’ambito delle sue verifiche, dei risultati del rapporto di audit della banca depositaria.
5 Può chiedere alla società di audit della banca depositaria le informazioni supplementari di cui necessita per l’esecuzione dei suoi compiti.

1 The audit company for the custodian bank shall specify in a separate audit report whether the custodian bank is complying with the supervision and the contractual provisions.
2 It must also include any reservation in the audit report under Article 27 paragraph 1 of the Financial Market Supervision Act of 22 June 2007208 on the custodian bank.
3 It shall submit the audit report under paragraph 1 to the following recipients:
4 The audit company for the fund management company or the SICAV shall take account of the results of the report on the audit of the custodian bank in their own audits.
5 It may request additional information from the audit company for the custodian bank that it requires to carry out its tasks.
