1 Nel caso di investimenti collettivi di capitale di difficile valutazione o di limitato impatto sul mercato, il regolamento del fondo può prevedere che la disdetta abbia luogo solo a determinate scadenze, ma almeno quattro volte all’anno.
2 La FINMA può, su richiesta motivata, limitare il diritto di riscatto in qualsiasi momento a seconda degli investimenti e della politica di investimento. Ciò vale segnatamente per:
3 Il regolamento del fondo, il prospetto e il foglio informativo di base devono menzionare espressamente se il diritto di riscatto in qualsiasi momento è limitato.164
4 Il diritto di riscatto in qualsiasi momento può essere sospeso per cinque anni al massimo.
5 Nel regolamento del fondo, la direzione del fondo e la SICAV possono prevedere una riduzione proporzionale delle richieste di riscatto al raggiungimento di una determinata percentuale o soglia in un determinato momento (gating), se sussistono circostanze eccezionali e se ciò è nell’interesse degli investitori rimanenti. La parte rimanente delle richieste di riscatto è da considerarsi pervenuta il successivo giorno di valutazione. I dettagli devono essere resi noti nel regolamento del fondo. La FINMA approva l’introduzione di un gating nel regolamento del fondo.165
6 La decisione relativa alla dilazione o al gating e alla sua soppressione deve essere comunicata senza indugio alla società di audit e alla FINMA. Essa va altresì comunicata in modo adeguato agli investitori.166

1 The regulations of a collective investment scheme whose value is difficult to ascertain, or which has limited marketability, may provide for notice to be served only on specific dates, subject to a minimum of four times per year.
2 FINMA may in the event of a justified request restrict the right to redeem at any time depending on the investments and investment policy. This shall apply specifically in the case of:
3 Where the right to redeem at any time is restricted, such fact must be stated explicitly in the fund regulations, in the prospectus and in the key information document.161
4 The right to redeem at any time may be suspended for a maximum of five years.
5 The fund management company and the SICAV may permit a pro rata cutting off of redemption applications on reaching a specific percentage or threshold on a specific trading day in exceptional circumstances if this is in the interests of the remaining investors (gating). The remaining portion of redemption applications shall be considered submitted for the subsequent valuation day. Details must be disclosed in the fund regulations. FINMA approves the inclusion of gating in the fund regulations.162
6 The audit company and FINMA must be informed immediately of any decision on deferral or gating as well as any lifting of such. Investors must also be notified in a suitable manner.163
