Art. 2 Obblighi di diligenza

1 Chi offre un’attività sottoposta alla presente legge deve adottare le misure imposte dall’esperienza, possibili secondo lo stato della tecnica e commisurate alle condizioni date, affinché non siano messe in pericolo la vita e la salute dei partecipanti.

2 Egli deve segnatamente:

a.
informare i clienti sui particolari rischi che possono derivare dalla pratica dell’attività scelta;
b.
verificare che i clienti possiedano le attitudini necessarie per praticare l’attività scelta;
c.
provvedere affinché il materiale non presenti difetti e le installazioni siano in buono stato;
d.
verificare che le condizioni meteorologiche e le condizioni di innevamento siano adeguate;
e.
provvedere affinché il personale sia sufficientemente qualificato;
f.
provvedere affinché il numero di accompagnatori sia commisurato al grado di difficoltà e al pericolo;
g.
rispettare l’ambiente e, in particolare, preservare gli spazi vitali della fauna e della flora.

Art. 2 Duties of care

1 Any person who offers an activity that is subject to this Act must take the measures that experience indicates are required, that are possible according to the state of the art and that are appropriate in the given conditions, so that the lives and health of the participants are not endangered.

2 He or she must in particular:

a.
alert clients to the specific dangers that may be related to carrying out the activity concerned;
b.
assess whether the clients have the capacity to carry out the activity concerned;
c.
ensure that equipment is free of defects and installations are in a good condition;
d.
assess the suitability of the weather and snow conditions;
e.
ensure that staff are adequately qualified;
f.
ensure that a sufficient number of support staff are available according to the degree of difficulty and the danger;
g.
show consideration for the environment and in particular the habitats of flora and fauna.
