Art. 19 Disposizione transitoria

1 Su domanda e dietro pagamento di un emolumento, è iscritto nel registro dei consulenti in brevetti chi al momento dell’entrata in vigore della presente legge:

a.
ha esercitato a tempo pieno per oltre sei anni un’attività di consulenza in brevetti in Svizzera, ha conseguito un diploma universitario in scienze naturali o in ingegneria rilasciato da una scuola universitaria svizzera o un diploma universitario estero secondo l’articolo 5 capoverso 1 e dispone di un recapito in Svizzera; oppure
b.
ha esercitato a tempo pieno per oltre tre anni un’attività di consulenza in brevetti in Svizzera, è iscritto nell’elenco dei mandatari accreditati tenuto dall’Ufficio europeo dei brevetti e dispone di un recapito in Svizzera.

2 La domanda va presentata entro due anni dall’entrata in vigore della presente legge.

3 Il richiedente deve dimostrare, con documenti idonei, di adempiere i requisiti di cui al capoverso 1 lettera a o b.

4 L’IPI rilascia un attestato a conferma dell’avvenuta iscrizione.

Art. 19 Transitional provisions

1 A person shall be registered in the Patent Attorney Register on application and on payment of a fee provided that, on commencement of this Act, he or she has been working professionally as a patent attorney on a full-time basis in Switzerland:

a.
for more than six years, possesses a higher education qualification in natural sciences or engineering from a Swiss higher education institution or a foreign higher education qualification as defined in Article 5 paragraph 1, and has an address for service in Switzerland; or
b.
for more than three years, is registered in the list of professional representatives maintained by the European Patent Office and has an address for service in Switzerland.

2 Application must be made within two years of commencement of this Act.

3 The applicant must prove, by means of suitable documentation, that he or she fulfils the requirements of paragraph 1 letter a or b.

4 The IPI shall issue a certificate of registration.
