Art. 59 Obbligo d’informazione

1 Le persone sottostanti alla presente legge devono fornire all’autorità competente le informazioni necessarie alla sua esecuzione e alla sua valutazione.185

2 Sono tenute a presentare regolarmente all’UFCOM i dati necessari all’allestimento di una statistica ufficiale sulle telecomunicazioni.186

2bis I dati raccolti o comunicati a scopi statistici possono essere utilizzati per altri scopi unicamente se:

a.
una legge federale lo permette espressamente;
b.
la persona interessata vi acconsente per scritto;
c.
essi servono per valutare la legislazione sulle telecomunicazioni; o
d.
essi servono quale base per l’adozione delle necessarie decisioni regolatrici.187

2ter L’UFCOM può pubblicare le quote di mercato.188

3 Il Consiglio federale disciplina i dettagli.

Art. 59 Obligation to disclose information

1 The persons subject to this Act shall be obliged to provide the competent authority with the information required to implement and evaluate this Act.181

2 They must provide OFCOM regularly with the necessary information to produce official telecommunications statistics.182

2bis Data collected or submitted for statistical purposes may be used for other purposes only if:

a.
a federal act explicitly allows this;
b.
the person concerned consents in writing;
c.
this serves the evaluation of telecommunications legislation; or
d.
this serves as a basis for necessary regulatory decisions.183

2ter OFCOM may publish market shares.184

3 The Federal Council shall regulate the details.
