Art. 28 Forma e contenuto della domanda

1 La domanda deve essere scritta.

2 Essa deve indicare:

a.
l’ufficio da cui emana e all’occorrenza l’autorità competente per il procedimento penale;
b.
l’oggetto e il motivo;
c.
la qualificazione giuridica del reato;
d.
i dati, il più possibile precisi e completi, della persona contro cui è diretto il procedimento penale.

3 Per l’apprezzamento giuridico del reato devono essere allegati:

a.
un breve esposto dei fatti essenziali, salvo ove trattasi di una domanda di notificazione;
b.75
le disposizioni applicabili nel luogo in cui il reato è stato commesso, salvo ove trattasi di una domanda d’assistenza secondo la parte terza della presente legge.

4 I documenti ufficiali esteri non richiedono legalizzazione.

5 Le domande estere e i documenti a sostegno devono essere presentati in lingua tedesca, francese o italiana o con una traduzione in una di queste lingue. Le traduzioni devono essere ufficialmente certificate conformi.

6 Se la domanda non soddisfa alle esigenze formali si può esigerne la rettificazione o il completamento; rimane salva la possibilità di ordinare misure provvisionali.

Art. 28 Form and content of requests

1 Requests shall be made in writing.

2 The following information must be provided in a request:

a.
the office issuing the request and, if applicable, the authority having criminal jurisdiction;
b.
the subject matter of and the reason for the request;
c.
the legal term for the offence;
d.
details that are as exact and complete as possible on the person who is the subject of the criminal proceedings.

3 To permit the legal assessment of the offence, the following shall be added:

a.
a summary of the relevant allegations, except in the case of requests for service;
b.76
the wording of the regulations applicable at the place where the offence was committed, except for requests for assistance in accordance with Part Three of this Act.

4 Foreign official records need not be legalised.

5 Foreign requests and their enclosures shall be submitted in German, French or Italian or be accompanied by a translation into one of these languages. Translations must be officially certified.

6 If a request does not meet the formal requirements, its correction or completion may be demanded; the ordering of provisional measures is not affected thereby.
