Art. 15 Indennità per ingiusta carcerazione

1 Gli articoli 429 e 431 CPP43 si applicano per analogia nei procedimenti condotti in Svizzera conformemente alla presente legge, o all’estero a domanda di un’autorità svizzera.44

2 La Confederazione provvede alla riparazione qualora la domanda sia presentata o eseguita da un’autorità federale. Essa ha diritto di regresso verso il Cantone che ha provocato la domanda.

3 L’indennità può essere ridotta o rifiutata se la persona perseguita ha provocato per sua colpa l’istruttoria o la sua carcerazione oppure se, con temerarietà, ha intralciato o protratto il procedimento.45

4 L’indennità per il carcere sofferto in Svizzera ai fini d’estradizione può anche essere decurtata o rifiutata se lo Stato richiedente:

a.
ritira la domanda di ricerca o di fermo in vista d’estradizione; o
b.
non presenta la domanda d’estradizione con i relativi allegati nel termine fissato.46

5 Qualora sia decisa la decurtazione o il rifiuto dell’indennità secondo il capoverso 4, si devono considerare le possibilità del danneggiato di ottenere un indennizzo nello Stato estero.47

Art. 15 Compensation

1 Articles 429 and 431 CrimPC44 apply by analogy in proceedings that have been conducted against the defendant under this Act in Switzerland or at the instigation of a Swiss authority abroad.45

2 The Confederation shall pay the compensation if a federal authority makes or executes a request. It may require reimbursement from the canton that caused the request to be made.

3 The compensation may be reduced or refused if the defendant has provoked the investigation or the detention through his fault, or has, without reason, obstructed or delayed the proceedings.46

4 Compensation for detention pending extradition served in Switzerland may also be reduced or refused if the requesting State:

a.
withdraws the request for search and arrest with a view to extradition; or
b.
does not present the request for extradition with the necessary enclosures within the deadline set.47

5 The likelihood of the injured party being able to obtain damages in the foreign State must be taken into account when the decision is made to reduce or refuse the compensation.48
