Art. 108

1 Le decisioni straniere concernenti diritti reali su fondi sono riconosciute in Svizzera se sono state pronunciate o vengano riconosciute nello Stato di situazione dei fondi.

2 Le decisioni straniere concernenti diritti reali su cose mobili sono riconosciute in Svizzera se pronunciate:

a.
nello Stato di domicilio del convenuto;
b.
nello Stato di situazione della cosa, sempreché il convenuto vi dimori abitualmente;

59 Abrogata dall’art. 2 del DF del 3 ott. 2008 che approva e traspone nel diritto svizzero la Conv. dell’Aia sulla L applicabile ad alcuni diritti su strumenti finanziari detenuti presso un intermediario, con effetto dal 1° gen. 2010 (RU 2009 6579; FF 2006 8533).

Art. 108

1 Foreign decisions on rights in rem in immovable property are recognised in Switzerland if they were rendered in the state in which the property is located or if they are recognised in such state.

2 Foreign decisions on rights in rem in movable property are recognised in Switzerland:

a.
if they were rendered in the state of domicile of the defendant; or
b.
if they were rendered in the state in which the property is located, provided the defendant had their habitual residence there.
