Art. 108 Spese giudiziarie inutili

Le spese giudiziarie inutili sono a carico di chi le ha causate.

Art. 109 Allocation in the event of a settlement

1 If a case is settled in court, the costs are charged to the parties according to the terms of the settlement.

2 The costs are allocated according to Articles 106–108:

a
if the settlement does not provide for the allocation of costs; or
b.
if, in terms of the settlement, the costs are charged solely to a party that has been granted legal aid.
