Art. 140z

1 L’IPI rilascia, su richiesta, un certificato per ogni principio attivo o composizione di principi attivi di un prodotto fitosanitario.

2 Gli articoli 140a capoverso 2 e 140b–140m sono applicabili per analogia.

3 Un principio attivo è una sostanza o un microorganismo, compresi i virus, con effetti generici o specifici:

a.
contro organismi nocivi;
b.
su vegetali, parti di vegetali o prodotti vegetali.

Art. 143

1 Patent applications that are pending when the Amendment to this Act of 22 June 2007 comes into force are subject to the new law from that date.

2 However, the following are also governed by the previous law:

a.
non-prejudicial disclosures at international exhibitions;
b.
patentability, if the requirements are more favourable under the previous law.
