Art. 19 Condizioni generali

1 Il design è considerato depositato dal momento in cui è presentata una domanda di registrazione all’IPI. La domanda contiene:7

a.
la richiesta di registrazione;
b.
una raffigurazione del design idonea per la riproduzione; se la raffigurazione non soddisfa questa condizione, l’IPI8 concede al depositante9 un termine per ovviare a tale mancanza.

2 Entro il termine fissato dall’IPI, va inoltre pagato l’emolumento previsto per il primo periodo di protezione.

3 Nel caso in cui il design depositato sia bidimensionale (disegno) e sia stato chiesto il differimento della pubblicazione ai sensi dell’articolo 26, si può inviare un esemplare del design in luogo e vece della raffigurazione. Se è tuttavia previsto che la protezione del design debba essere mantenuta dopo la scadenza del differimento10, va preventivamente fatta pervenire all’IPI una raffigurazione del design idonea per la riproduzione.

4 Contro versamento di un emolumento, il design può essere corredato di una descrizione di 100 parole al massimo al fine di spiegare la raffigurazione.

Art. 19 General requirements

1 A design is considered to have been filed once an application for registration has been submitted to IPI. The application must contain:6

a.
a request for registration;
b.
a representation of the design suitable for reproduction; if the representation does not fulfil this requirement, the IPI will set a time limit within which the applicant must remedy the defect.

2 The prescribed fee for the first period of protection must also be paid within the time limit set by the IPI7.

3 If a two-dimensional design is filed for which a deferment of publication has been requested under Article 26, a specimen of the design may be filed in lieu of the representation. If design protection is to be maintained beyond expiry of the deferment period, a representation of the design suitable for reproduction must first be submitted to the IPI.

4 On payment of a fee, a description of the design containing no more than 100 words may be included to explain the representation of the design.
