Art. 4 Segretariato

1 Il dipartimento nomina il segretario della Commissione arbitrale d’intesa con il presidente di detta Commissione. Il segretariato è diretto da un segretario- giurista. Il dipartimento mette a disposizione della Commissione arbitrale l’infrastruttura necessaria.8

1bis I I rapporti di lavoro degli impiegati del segretariato sono retti dalla legislazione sul personale della Confederazione.9

2 Nell’esercizio delle sue funzioni, il segretariato è indipendente dalle autorità amministrative ed è vincolato unicamente alle direttive del presidente.

3 Il segretario-giurista assolve segnatamente le seguenti mansioni:

a.
redazione di decisioni, osservazioni e comunicati alle parti e alle autorità;
b.
stesura dei verbali;
c.
gestione della documentazione, informazione della Commissione arbitrale e rielaborazione redazionale delle decisioni destinate alla pubblicazione.

4 Il segretario-giurista ha voto consultivo nei dibattiti in cui gli è stata affidata la stesura del verbale.

Art. 4 Secretariat

1 In agreement with the chair of the Arbitration Commission, the Department shall appoint the secretariat of the Arbitration Commission, which shall be headed by a legal secretary. The Department shall provide the necessary infrastructure.7

1bis The employment relationship of the secretariat personnel is governed by federal legislation on the personnel of the Confederation.8

2 The secretariat is independent from the administrative authorities in carrying out its functions and is only bound to the instructions of the chair.

3 The legal secretary shall carry out the following tasks, in particular:

a.
drafting decisions, consultations and communications addressed to parties and authorities;
b.
taking minutes;
c.
maintaining documentation, providing the public with information about the Arbitration Commission and editing decisions intended for publication.

4 The legal secretary acts in an advisory capacity in procedures in which he or she is taking minutes.
