Art. 39 Condizioni per l’accreditamento di un soggetto qualificato

L’UFAC accredita i soggetti qualificati per la valutazione delle autorizzazioni operative sulla base dei seguenti criteri:

a.: il soggetto qualificato deve possedere le competenze necessarie per valutare le domande di autorizzazione operativa e deve disporre di personale adeguatamente formato per adempiere correttamente i compiti;
b.: il soggetto qualificato, il suo direttore e il personale responsabile devono garantire una valutazione indipendente conformemente al punto 1 dell’allegato VI del regolamento (UE) 2018/1139 ed esaminare le domande con la massima diligenza possibile;
c.: il soggetto qualificato dispone di un processo che permette di seguire gli sviluppi sul piano internazionale delle basi di valutazione delle domande secondo la metodologia SORA¹⁴;
d.: il soggetto qualificato ha sottoscritto un’assicurazione responsabilità civile destinata a coprire eventuali sinistri.

Art. 39 Voraussetzungen für Akkreditierung zur qualifizierten Stelle

Das BAZL akkreditiert qualifizierte Stellen für das Beurteilen von Betriebsgenehmigungen anhand der folgenden Kriterien:

a.: Die qualifizierte Stelle muss die nötigen Kompetenzen im Beurteilen der Anträge für eine Betriebsgenehmigung haben und über das entsprechend ausgebildete Personal für die korrekte Erfüllung der Aufgaben verfügen.
b.: Die qualifizierte Stelle, deren Leiterin oder Leiter und das zuständige Personal müssen eine unabhängige Bewertung im Sinne der Ziffer 1 des Anhangs VI der Verordnung 2018/1139 der Anträge gewährleisten und die Anträge mit der grösstmöglichen Sorgfalt prüfen.
c.: Die qualifizierte Stelle verfügt über einen Prozess, mit dessen Hilfe die Entwicklungen hinsichtlich der Beurteilungsgrundlagen von Anträgen nach der SORA-Methodologie¹⁴ auf internationaler Ebene verfolgt werden können.
d.: Die qualifizierte Stelle verfügt über eine Haftpflichtversicherung zur Abdeckung eventueller Schadensfälle.
