Art. 4 Avant la conclusion du contrat

1 L’organisateur ou le détaillant doit communiquer par écrit au consommateur toutes les clauses du contrat avant sa conclusion.

2 Les clauses du contrat peuvent être transmises au consommateur sous une autre forme appropriée; dans ce cas, elles doivent lui être confirmées, avant la conclusion du contrat, par une copie écrite. La confirmation écrite n’est pas exigée lorsqu’elle empêcherait la conclusion d’une réservation ou d’un contrat.

3 Pour autant que cela soit important pour le voyage à forfait, l’organisateur ou le détaillant doit fournir au consommateur, par écrit ou sous toute autre forme appropriée, avant la conclusion du contrat, des informations d’ordre général concernant:

a.
les conditions applicables aux ressortissants des Etats de la CE et de l’AELE en matière de passeports et de visas, notamment quant aux délais pour leur obtention;
b.
les informations relatives aux formalités sanitaires requises pour le voyage et le séjour.

4 Les ressortissants d’autres Etats ont droit aux informations prévues au 3e alinéa, lettre a, s’ils les exigent sans retard.

Art. 4 Before conclusion of the contract

1 The organiser or the retailer must communicate all the terms and conditions of the contract to the consumer in writing before the contract is concluded.

2 The terms of the contract may also be brought to the consumer’s attention in another appropriate form, provided that they are confirmed to him in writing before the contract is concluded. The obligation to confirm in writing does not apply if compliance would prevent the conclusion of the contract.

3 Where it is relevant for the package, the organiser or the retailer shall provide the consumer, in writing or any other appropriate form, with general information on:

a.
passport and visa requirements applicable to nationals of the states of the EC and the EFTA, and in particular on the periods for obtaining them;
b.
health formalities required for the journey and the stay.

4 Nationals of any other states are entitled to such information according to paragraph 3 letter a above, if they request the same immediately.
