1 Le Conseil fédéral et l’institut exécutent les tâches qui sont attribuées par la présente loi à la Confédération. L’institut est l’autorité d’exécution pour les produits visés à l’art. 2a. L’exécution du chapitre 4, section 2a, incombe à l’OFSP. Le Conseil fédéral peut déléguer à d’autres autorités certaines tâches de l’institut ou de l’OFSP.223
2 Le Conseil fédéral édicte les dispositions d’exécution pour autant que la présente loi ne déclare pas l’institut compétent ou qu’il n’a pas confié à celui-ci la compétence d’édicter des prescriptions de nature technique et d’importance mineure.
3 Le Conseil fédéral peut prévoir que certains actes délégués et certains actes d’exécution de la Commission européenne dans le domaine des dispositifs médicaux s’appliquent également en Suisse dans la version qui s’applique aux États membres de l’Union européenne, pour autant qu’il s’agisse de modalités techniques ou administratives dont la réglementation est adaptée régulièrement et en général à court terme.224

1 The Federal Council and the Agency shall enforce this Act insofar as the Act states that the Confederation is competent to do so. The Agency is the enforcement authority for products specified in Article 2a. The FOPH is responsible for the enforcement of Chapter 4 Section 2a. The Federal Council may delegate certain of the Agency’s or the FOPH’s tasks to other authorities.220
2 The Federal Council shall enact the implementing provisions unless this Act states that the Agency is competent to do so, or when it has not allocated the enactment of provisions of a technical nature or of minor importance to the Agency.
3 Insofar as certain delegated acts and implementing acts of the European Commission in the area of medical devices concern technical or administrative details that are regulated on an ongoing basis and generally amended at short notice, the Federal Council may determine that the relevant acts in the version binding for EU member states are also to be applicable in Switzerland.221
