Art. 39 Mesures

1 Si le contrôle établit une violation des dispositions de la présente ordonnance ou des prescriptions de l’OFCOM, ce dernier peut, après avoir entendu la personne responsable de la mise à disposition sur le marché ou de l’exploitation, ordonner les mesures prévues à l’art. 33, al. 3, LTC. Il peut publier ces mesures ou les rendre accessibles en ligne.

2 Lorsque la documentation technique ne fournit pas suffisamment d’informations ou de précisions utiles sur les moyens employés pour garantir la conformité des installations de télécommunication aux exigences essentielles de la présente ordonnance et n’est donc pas conforme à l’art. 14, l’OFCOM peut demander au fabricant ou à l’importateur qu’il fasse réaliser, à ses propres frais et sur une période donnée, un essai par un laboratoire accepté par l’OFCOM afin de vérifier la conformité aux exigences essentielles de la présente ordonnance.

3 L’art. 19, al. 7, LETC est applicable.

4 Lorsque l’OFCOM informe la population en application de l’art. 33, al. 4, LTC, il publie ou rend accessibles en ligne en particulier les informations suivantes:50

a.
les mesures prises;
b.
l’usage auquel l’installation de télécommunication est destinée;
c.
les informations permettant son identification, telles que le fabricant, la marque et le type;
d.
des photographies de l’installation de télécommunication et de son emballage;
e.
la date de la décision de non-conformité.

Art. 39 Measures

1 If the inspection shows that regulations in this Ordinance or OFCOM’s regulations are being violated, after hearing the person responsible for placing the telecommunications installation on the market or for its operation, OFCOM shall order measures provided for in Article 33 paragraph 3 TCA. It may publish notice of the measures or make such notice accessible online.

2 If the technical documentation does not present sufficient relevant information or references to ensure compliance of the telecommunications installations with the essential requirements set out in this Ordinance, and if the requirements of Article 14 are therefore not met, OFCOM may request the manufacturer or the importer to have a test performed by a body acceptable to OFCOM at the expense of the manufacturer or the importer within a specified period in order to verify compliance with the essential requirements set out in this Ordinance.

3 Article 19 paragraph 7 TBTA applies.

4 If OFCOM provides information to the public pursuant to Article 33 paragraph 4 TCA, it shall publish the following information in particular or make it available online:52

a.
the measures taken;
b.
how to use the telecommunications installation as intended;
c.
the information that enable it to be identified, such as the manufacturer, trademark and type;
d.
photographs of the telecommunications installation and its packaging;
e.
the date of the ruling on non-conformity.
