Art. 23 Fiche de données sur les lignées génétiquement modifiées et des mutants présentant un phénotype invalidant

(art. 124 OPAn)

1 Les principales informations relatives aux lignées génétiquement modifiées et aux mutants présentant un phénotype invalidant sont à inscrire sur un document récapitulatif (fiche de données). Cette fiche de données doit comporter les informations suivantes:

a.
les informations scientifiques de base visées à l’annexe 2;
b.
un résumé de la caractérisation de la contrainte au sens de l’annexe 3;
c.
le cas échéant, la décision relative aux lignées présentant un phénotype invalidant (art. 127 OPAn).

2 La fiche de données sera remise à l’autorité cantonale au plus tard lors du dépôt de la demande d’autorisation de pratiquer des expériences sur animaux avec la lignée ou les mutants en question, ou lors de la notification de la lignée ou des mutants à l’autorité cantonale.

3 La fiche de données tient lieu de communication au sens de l’art. 13 de l’ordonnance du 25 août 1999 sur l’utilisation des organismes en milieu confiné3 en cas de transfert d’animaux génétiquement modifiés d’un milieu confiné dans un autre. Au moment de la cession d’une lignée nouvelle qui n’a pas encore été suffisamment caractérisée ou d’une lignée susceptible de présenter un phénotype invalidant, il sera également remis à l’acquéreur toutes les données recueillies à cette date.

Art. 23 Data sheet for genetically modified lines and mutants that have a clinical pathological phenotype

(Art. 124 AWO)

1 In the case of genetically modified lines and mutants that have a clinical pathological phenotype, the most important information shall be entered in a summarising document (data sheet). The data sheet contains the following information:

a.
the basic scientific data in accordance with Annex 2;
b.
a summary of strain recording in accordance with Annex 3;
c.
where applicable, the decision on lines that have a clinical pathological phenotype (Art. 127 AWO).

2 The data sheet shall be submitted to the cantonal authorities at the latest when an application for animal experiments using the line or mutant in question is submitted for approval or when a report is submitted concerning this line or these mutants.

3 It serves as a communication in accordance with Article 13 of the Containment Ordinance of 25 August 19993 when genetically modified animals are moved from one enclosed system to another. When a new line that is not yet sufficiently characterised or a line that probably has a clinical pathological phenotype is passed on, all data available up to this time shall be provided with the animals.
