1 La Commission arbitrale fédérale pour la gestion de droits d’auteur et de droits voisins (Commission arbitrale) est compétente pour approuver les tarifs des sociétés de gestion (art. 46).
2 Le Conseil fédéral en nomme les membres. Il règle l’organisation et la procédure à suivre devant la Commission arbitrale conformément aux principes de la loi fédérale du 20 décembre 1968 sur la procédure administrative65.
3 Pour ses décisions, la Commission arbitrale ne prend en considération aucune instruction; le personnel du secrétariat est subordonné pour cette activité au président de la commission.
1 The Federal Arbitration Commission for the Exploitation of Copyrights and Related Rights (Arbitration Commission) is responsible for approving the tariffs of the collective rights management organisations (Art. 46).
2 Its members are appointed by the Federal Council. It regulates the organisation and procedures of the Arbitration Commission in accordance with the Administrative Procedure Act of 20 December 196855.
3 The Arbitration Commission accepts no directives in taking its decisions; the staff of the Secretariat of the Commission are answerable for such activity to the Chairman of the Commission.
