Art. 42 Conclusion du contrat

1 Dans le cas des marchés non soumis aux accords internationaux, un contrat peut être conclu avec le soumissionnaire retenu après l’adjudication.

2 Dans le cas des marchés soumis aux accords internationaux, un contrat peut être conclu avec le soumissionnaire retenu après l’écoulement du délai de recours contre l’adjudication, à moins que le Tribunal administratif fédéral n’ait accordé l’effet suspensif à un recours formé contre l’adjudication.

3 Lorsqu’une procédure de recours contre l’adjudication d’un marché soumis aux accords internationaux est pendante sans que l’effet suspensif ait été demandé ou octroyé, l’adjudicateur informe immédiatement le tribunal de la conclusion du contrat.

Art. 42 Conclusion of the contract

1 In the case of contracts outside the scope of international treaties, a contract may be concluded with the selected tenderer after the award has been made.

2 In the case of contracts within the scope of international treaties, a contract may be concluded with the selected tenderer after expiry of the deadline for appealing against the award, unless the Federal Administrative Court has granted suspensive effect to an appeal against the award.

3 If, in the case of contracts within the scope of international treaties, an appeal procedure against the award is pending without suspensive effect having been requested or granted, the contracting authority shall notify the court immediately of the conclusion of the contract.
