Art. 17 Emoluments

1 L’accès aux documents officiels est en principe soumis au paiement d’un émolument.9

2 Il n’est pas perçu d’émolument:

a.
pour le règlement des demandes qui occasionnent peu de frais;
b.
pour la procédure de médiation (art. 13);
c.
pour la procédure en première instance (art. 15).

3 Le Conseil fédéral règle les modalités et fixe le tarif des émoluments en fonction des frais effectifs. Les dispositions spéciales prévues dans d’autres lois sont réservées.

4 La remise de rapports, de brochures ou d’autres imprimés et supports d’information, peut, dans tous les cas, être subordonnée au paiement d’un émolument.

Art. 17 Fees

1 In principle, access to official documents is subject to payment of a fee.9

2 No fee is charged for:

a.
the processing of an application which gives rise to minimal costs;
b.
mediation proceedings (Art. 13); and
c.
proceedings before the first instance (Art. 15).

3 The Federal Council shall regulate the details and fee rates on the basis of the effective costs incurred. Specific provisions set out in other legislation are reserved.

4 Fees may, in any event, be charged for the release of reports, brochures and other printed material and information carriers.
