Art. 28c Firearms and essential or specially designed weapon components

1 Exemption permits for the transfer of possession, acquisition, brokerage for recipients in Switzerland, bringing into Switzerland and possession of objects specified in Article 5 paragraph 1 may only be issued if:

a.
there are legitimate grounds for doing so;
b.
no impediments under Article 8 paragraph 2 exist; and
c.
the special requirements of this Act are met.

2 Legitimate grounds are in particular:

a.
professional requirements, in particular with regard to carrying out protection duties, such as protecting persons, critical infrastructure or the transport of valuables;
b.
recreational target shooting;
c.
collecting;
d.
national defence requirements;
e.
educational, cultural, research or historical purposes.

3 Exemption permits for shooting in accordance with Article 5 paragraphs 3 and 4 may be issued if there are no impediments under Article 8 paragraph 2 and suitable measures are taken to guarantee safety.

nagins motivs d’impediment tenor l’artitgel 8 alinea 2 n’èn avant maun; e
c.
las premissas particularas previsas da questa lescha èn ademplidas.

2 Sco motivs respectabels valan:

a.
necessitads professiunalas, en spezial concernent l’adempliment d’incumbensas da protecziun sco la protecziun da persunas, d’infrastructuras criticas u da transports da valurs;
b.
il tir da sport;
c.
in’activitad da collecziun;
d.
necessitads da la defensiun naziunala;
e.
intents da furmaziun, da cultura, da perscrutaziun ed intents istorics.

3 Permissiuns excepziunalas per sajettar tenor l’artitgel 5 alineas 3 e 4 pon vegnir concedidas, sch’i n’èn avant maun nagins motivs d’impediment tenor l’artitgel 8 alinea 2 e sche la segirezza è garantida tras mesiras adattadas.

102 Integrà tras l’agiunta dal COF dals 28 da sett. 2018 davart l’approvaziun e la realisaziun dal barat da notas tranter la Svizra e la UE concernent la surpigliada da la directiva (UE) 2017/853 per midar la directiva da la UE davart las armas, en vigur dapi ils 15 d’avust 2019 (AS 2019 2415; BBl 2018 1881).
