Art. 318 Decision

¹ The appellate court may:

a.

confirm the challenged decision;

b.

make a new decision; or

c.

remit the case to the first instance if:

1.: an essential part of the claim was not considered, or
2.: essential issues of fact must still be established.

² The appellate court shall give notice of its decision to the parties with a written statement of grounds.

³ If the appellate court makes a new decision, it shall also decide on the costs at first instance.
