958.1 Legge federale del 19 giugno 2015 sulle infrastrutture del mercato finanziario e il comportamento sul mercato nel commercio di valori mobiliari e derivati (Legge sull'infrastruttura finanziaria, LInFi)
Art. 18 Fair and open access
1 A financial market infrastructure shall ensure fair and open access to its services.
2 It may restrict access to its services:
- a.
- if this increases safety or efficiency and this effect cannot be achieved with other measures; or
- b.
- if the features of the potential participant could jeopardise the business operations of the financial market infrastructure or its participants.
Art. 18 Accesso non discriminatorio e aperto
1 L’infrastruttura del mercato finanziario garantisce un accesso non discriminatorio e aperto ai propri servizi.
2 Può limitare l’accesso a detti servizi, se:
- a.
- in tal modo aumenta la sicurezza o l’efficienza e tale effetto non può essere ottenuto con altri mezzi; oppure
- b.
- le caratteristiche del possibile partecipante potrebbero pregiudicare l’attività dell’infrastruttura del mercato finanziario o dei suoi partecipanti.
