Art. 35 Form and content of the declaration

¹ The declaration must be written in an official language or in English and be submitted electronically in the format required by the Notification Authority. The accompanying letter must be written in an official language.

² The declaration must contain the following information and documents:

a.: the name and address of the manufacturer;
b.: if the manufacturer has imported the substance: the name and address of the foreign manufacturer;
c.: essential data relating to the identity of the substance;
d.: the intended uses;
e.: the amount of the substance that the manufacturer expects to place on the market each year in Switzerland;
f.: proposed classification and labelling;
g.: the research programme and a list of the people to whom the substance is to be supplied;
h.: in the case of dangerous substances or PBT or vPvB substances: a proposed safety data sheet.

³ The Notification Authority may request the manufacturer or only representative to furnish test reports that are relevant for the assessment of the substance, provided that they are available and can be obtained with reasonable effort.

Art. 35 Forma e contenuto della comunicazione

¹ La comunicazione deve essere redatta in una lingua ufficiale o in inglese e presentata in forma elettronica nel formato richiesto dall’organo di notifica. La lettera accompagnatoria deve essere redatta in una lingua ufficiale.

² La comunicazione deve comprendere i seguenti dati e documenti:

a.: il nome e l’indirizzo del fabbricante;
b.: se il fabbricante ha importato la sostanza, il nome e l’indirizzo del fabbricante straniero;
c.: i dati essenziali relativi all’identità della sostanza;
d.: gli impieghi previsti;
e.: la quantità della sostanza che il fabbricante prevede di immettere annualmente sul mercato in Svizzera;
f.: la classificazione e l’etichettatura previste;
g.: il programma di ricerca e un elenco delle persone cui è destinata la sostanza;
h.: per le sostanze pericolose, le sostanze PBT o vPvB: una proposta di scheda di dati di sicurezza.

³ L’organo di notifica può esigere dal fabbricante o dal rappresentante esclusivo rapporti d’esame pertinenti ai fini della valutazione della sostanza, sempreché siano disponibili e possano essere procurati con un onere sopportabile.
