Art. 15 Requests to use an alternative chemical name

1 Requests to use an alternative chemical name for a substance in a preparation must be written in an official language or in English and be submitted electronically in the format required by the Notification Authority. The accompanying letter must be written in an official language.

2 Requests must contain:

a.
the manufacturer’s name, address and telephone number;
b.
the following information relating to the substances whose identity is to remain confidential on the label:
1.
the chemical name,
2.
the Chemical Abstracts Service (CAS) registry number52,
3.
the EC number;
c.
the alternative name of the substance;
d.
the reasons for the request;
e.
the trade name or designation of the preparation;
f.
the information on the constituents in accordance with the provisions relating to the safety data sheet;
g.
the classification of the preparation;
h.
the labelling of the preparation;
i.
the intended uses of the preparation;
j.
the physical state;
k.
if applicable, the safety data sheet.

3 The Notification Authority shall decide on the request in consultation with the assessment authorities.

Art. 15 Domanda di impiego di un nome chimico alternativo

1 La domanda di impiego di un nome chimico alternativo di una sostanza in un preparato deve essere redatta in una lingua ufficiale o in inglese e presentata in forma elettronica nel formato richiesto dall’organo di notifica. La lettera accompagnatoria deve essere redatta in una lingua ufficiale.

2 La domanda deve recare:

a.
il nome, l’indirizzo e il numero di telefono del fabbricante;
b.
i seguenti dati relativi alle sostanze la cui identità deve essere mantenuta segreta nel quadro dell’etichettatura:
1.
il nome chimico,
2.
il numero stabilito dal Chemical Abstract Service (n. CAS)52,
3.
il numero CE;
c.
il nome sostitutivo della sostanza;
d.
i motivi della domanda;
e.
il nome commerciale o la designazione del preparato;
f.
indicazioni circa le sostanze contenute secondo le disposizioni relative alla scheda di dati di sicurezza;
g.
la classificazione del preparato;
h.
l’etichettatura del preparato;
i.
gli impieghi previsti del preparato;
j.
lo stato dell’aggregato;
k.
se del caso, la scheda di dati di sicurezza.

3 L’organo di notifica decide in merito alla domanda d’intesa con i servizi di valutazione.
