1 Where the manufacturer of a device is not domiciled in Switzerland, the device may only be placed on the market if the manufacturer designates an authorised representative domiciled in Switzerland by means of a written mandate.
2 The authorised representative is responsible for the formal and safety-related aspects of placing the device on the market.
3 The authorised representative’s rights and obligations and the scope of its mandate are governed by Article 11 EU-IVDR44.
4 The manufacturer and authorised representative may contractually agree that, instead of the authorised representative keeping available a copy of the technical documentation, the manufacturer shall, on request, submit the documentation straight to Swissmedic. The authorised representative must ensure that the documentation is submitted within seven days.
5 Changes in authorised representative are governed by Article 12 EU-IVDR.

1 Se il fabbricante non ha sede in Svizzera, i suoi dispositivi possono essere immessi in commercio solo se il fabbricante ha designato un mandatario con sede in Svizzera. Il mandato deve essere convenuto per scritto.
2 Il mandatario si occupa delle questioni formali e legate alla sicurezza inerenti all’immissione in commercio del dispositivo.
3 I suoi diritti e doveri nonché la portata del mandato sono retti dall’articolo 11 UE-IVDR44.
4 Il fabbricante e il mandatario possono concordare contrattualmente che la documentazione tecnica non sia mantenuta a disposizione in copia presso il mandatario, bensì trasmessa, su richiesta, direttamente a Swissmedic dal fabbricante. Il mandatario deve assicurare che la trasmissione a Swissmedic avvenga entro sette giorni.
5 Il cambio di mandatario è retto dall’articolo 12 UE-IVDR.
