Art. 75 Measures

1 If, after obtaining the Competition Commission’s report, DETEC ascertains that a broadcaster or another undertaking active in the radio and television market has jeopardised diversity of opinion and programming as a result of its abuse of its dominant position, it may take measures in the area of radio and television. As a rule, it takes a decision within three months of receipt of the report.

2 It may demand that the broadcaster or the undertaking concerned:

a.
ensures diversity by measures such as granting broadcasting time for third parties or cooperating with other participants in the market;
b.
takes measures against corporate journalism, such as issuing editorial statutes to ensure editorial freedom;
c.
should such measures prove to be clearly inadequate, adapts the business and organisational structure of the undertaking.

Art. 75 Provvedimenti

1 Se, sulla base della perizia della Commissione della concorrenza, il DATEC accerta che un’emittente o un’altra azienda attiva sul mercato radiotelevisivo ha minacciato la pluralità delle opinioni e dell’offerta abusando della sua posizione dominante sul mercato, esso può adottare provvedimenti nel settore radiotelevisivo. Di regola il DATEC decide entro tre mesi dalla data in cui ha ricevuto la perizia.

2 Il DATEC può esigere che l’emittente o l’azienda in questione:

a.
assicuri la pluralità mediante provvedimenti quali la concessione di un tempo d’antenna a terzi o la collaborazione con altri operatori del mercato;
b.
prenda provvedimenti contro il giornalismo di gruppo, quali l’adozione di uno statuto redazionale a tutela della libertà redazionale;
c.
adegui le proprie strutture imprenditoriali e organizzative, qualora i suddetti provvedimenti si rilevassero manifestamente insufficienti.
