Art. 38 Selection of partner jurisdictions

The Federal Council shall analyse the applicable data protection provisions and regularisation options in potential partner jurisdictions before proposing the introduction of the automatic exchange of information with these jurisdictions to the Federal Assembly. It shall summarise the results of its analysis in the dispatch.

Art. 39 Competenza di approvazione

L’Assemblea federale approva mediante decreto federale semplice:

a.
l’inclusione di uno Stato nell’elenco secondo la sezione 7 paragrafo 1 lettera f dell’Accordo SAI55;
b.
i trattati internazionali di sua competenza concernenti l’accesso al mercato di fornitori di servizi finanziari e la regolarizzazione fiscale di contribuenti conclusi con Stati di cui è prevista l’inclusione in detto elenco.
