Art. 35 Incorrect self-certification

A fine not exceeding CHF 10,000 shall be imposed on any person who wilfully provides an incorrect self-certification to a Swiss financial institution, does not notify a Swiss financial institution about changes in circumstances, or provides false information on changes in circumstances.

Art. 36 Denuncia spontanea

1 L’autore che denuncia spontaneamente una violazione degli obblighi è esente da pena se:

a.
ha fornito indicazioni complete ed esatte circa l’effettiva entità e il contenuto degli obblighi;
b.
ha contribuito a chiarire i fatti e all’adempimento degli obblighi; e
c.
in precedenza non si è mai denunciato spontaneamente per un’infrazione intenzionale di medesima natura.

2 L’impunità dell’autore ha effetto anche per i partecipanti.
