Art. 42 Participation by application

1 An installation operator may participate in the ETS by application if:

a.
it is engaged in an activity listed in Annex 7; and
b.
the total rated thermal input of the installations is at least 10 MW.118

2 If an operator anticipates that it will fulfil the participation conditions listed in paragraph 1 for the first time, it must submit the application no later than three months before the date of fulfilment.119

3 The application must contain information about:

a.
the activities listed in Annex 7;
b.121
the installed rated thermal inputs of the installations;
c.122
the greenhouse gases emitted from the installations in the preceding three years.

4 The FOEN may request additional information if required for assessing the application.

Art. 43

1 Nello stabilire se le condizioni di cui all’articolo 40 capoverso 1 o all’articolo 42 capoverso 1 siano soddisfatte e nel calcolare la quantità di diritti di emissione che un gestore di impianti deve consegnare annualmente alla Confederazione non sono considerati gli impianti negli ospedali.125

2 Il gestore di impianti può chiedere che inoltre non siano considerati i seguenti impianti:126

a.
gli impianti destinati esclusivamente alla ricerca, allo sviluppo e alla prova di nuovi prodotti e processi;
b.127
gli impianti destinati principalmente allo smaltimento dei rifiuti speciali secondo l’articolo 3 lettera c dell’ordinanza del 4 dicembre 2015128 sui rifiuti (OPSR).

3 Per i combustibili utilizzati negli impianti non considerati la tassa sul CO2 non è restituita.129
