Art. 38 Compensation

1 The Confederation may pay compensation to private and public sector undertakings for measures under Articles 5 paragraph 4 and 31-33 insofar as:

a.
the measures need to be taken quickly; and
b.
the undertakings do not suffer any substantial unreasonable loss.

2 The Federal Council shall decide on the conditions for compensation.

3 The FONES shall specify the compensation amount in each individual case and the requirements therefor. In particular it shall take into account the undertakings’ own particular interests in the measures and the benefits that they may draw from them.

Art. 38 Indennità

1 La Confederazione può accordare indennità alle imprese di diritto privato o pubblico per le misure di cui agli articoli 5 capoverso 4 e 31–33, se:

a.
le misure devono essere attuate rapidamente; e
b.
le imprese subiscono altrimenti un pregiudizio importante che non è ragionevolmente esigibile.

2 Il Consiglio federale stabilisce gli importi minimi e massimi delle indennità.

3 L’UFAE stabilisce, nel singolo caso, l’importo delle indennità e le condizioni cui queste sottostanno. A tale fine considera in particolare gli interessi delle imprese all’adozione delle misure e i vantaggi che esse ne traggono.
