Art. 33

1 Any person who wilfully carries out any of the following acts is liable to a custodial sentence not exceeding three years or to a monetary penalty:

a.152
offers for acquisition, transfers possession of, brokers, acquires, possesses, manufactures, alters, modifies, carries, exports to a Schengen state or brings into Switzerland weapons, essential or specially designed weapon components, weapon accessories, ammunition or ammunition components unlawfully;
abis.153 removes, effaces, alters or adds to the prescribed marking of firearms, their essential components or accessories in accordance with Article 18a unlawfully;
b.
brings into Switzerland, as the holder of a weapons trading permit, weapons, essential or specially designed weapon components, weapon accessories, ammunition or ammunition components without registering these objects or declaring them correctly;
c.
obtains a weapons trading permit under false pretences by providing incorrect or incomplete information;
d.
violates their obligations under Article 21;
e.
as the holder of a weapons trading permit fails to keep weapons, essential or specially designed weapon components, weapon accessories, ammunition or ammunition components in a safe place (Art. 17 para. 2 let. d);
f.154
as the holder of a weapons trading permit:
1.
manufactures or brings into Switzerland firearms, their essential components, weapon accessories or ammunition without marking these objects in accordance with Article 18a or 18b,
2.
offers for acquisition, acquires, transfers possession of or brokers firearms, their essential components, weapon accessories or ammunition that are not marked in accordance with Article 18a or 18b,
3.
offers for acquisition, acquires, transfers possession of or brokers firearms, their essential or specially designed components, weapon accessories or ammunition that have been brought into Switzerland unlawfully;
g.
as a person in accordance with Article 7 paragraph 1, offers for acquisition, transfers possession of or brokers weapons, essential or specially designed weapon components, weapon accessories, ammunition or ammunition components and who is not able to produce an exemption permit in accordance with Article 7 paragraph 2.

2 If the perpetrator acts negligently, the penalty is a fine. The penalty may be waived in minor cases.

3 Any person who wilfully and on a commercial basis unlawfully:

a.155
offers for acquisition, transfers possession of, brokers, manufactures, repairs, alters, modifies, takes to a Schengen state or brings into Switzerland weapons, essential or specially designed weapon components, weapon accessories, ammunition or ammunition components;
b.156

offers for acquisition, acquires, transfers possession of or brokers firearms, their essential or specially designed weapon components, weapon accessories or ammunition that have not been marked in accordance with Article 18a or 18b, or that have been brought into Switzerland unlawfully;
is liable to a custodial sentence not exceeding five years or a monetary penalty.

Art. 33

1 È punito con una pena detentiva fino a tre anni o con una pena pecuniaria chiunque intenzionalmente:

a.156
senza diritto offre, aliena, procura per mediazione, acquista, possiede, fabbrica, modifica, trasforma, porta, esporta in uno Stato Schengen o introduce sul territorio svizzero armi, parti di armi essenziali o costruite appositamente, accessori di armi, munizioni o elementi di munizioni;
abis.157
senza diritto rimuove, rende irriconoscibile, modifica o completa il contrassegno di armi da fuoco, di loro parti essenziali o di loro accessori prescritto dall’articolo 18a;
b.
in qualità di titolare di una patente di commercio di armi, in previsione o in occasione dell’introduzione sul territorio svizzero, non denunzia armi, parti di armi, essenziali o costruite appositamente, accessori di armi, munizioni o elementi di munizioni oppure fornisce false dichiarazioni;
c.
ottiene fraudolentemente una patente di commercio di armi fornendo informazioni false o incomplete;
d.
viola gli obblighi di cui all’articolo 21;
e.
in qualità di titolare di una patente di commercio di armi non custodisce in modo sicuro armi, parti di armi, essenziali o costruite appositamente, accessori di armi, munizioni o elementi di munizioni (art. 17 cpv. 2 lett. d);

in qualità di titolare di una patente di commercio di armi:
1.
fabbrica o introduce sul territorio svizzero armi da fuoco, loro parti essenziali, accessori di armi o munizioni senza munirli di un contrassegno conformemente all’articolo 18a o 18b,
2.
offre, acquista, aliena o procura per mediazione armi da fuoco, loro parti essenziali, accessori di armi o munizioni non contrassegnati conformemente all’articolo 18a o 18b,
3.
offre, acquista, aliena o procura per mediazione armi da fuoco, loro parti essenziali o costruite appositamente, accessori di armi o munizioni introdotti illecitamente sul territorio svizzero.
g.
offre, aliena o procura per mediazione armi, parti di armi, essenziali o costruite appositamente, accessori di armi, munizioni o elementi di munizioni a persone ai sensi dell’articolo 7 capoverso 1 che non sono in grado di presentare un’autorizzazione eccezionale ai sensi dell’articolo 7 capoverso 2.

2 Chi ha agito per negligenza è punito con la multa. Nei casi di poca gravità si può prescindere da ogni pena.

3 È punito con una pena detentiva fino a cinque anni o con una pena pecuniaria chiunque senza diritto, intenzionalmente e per mestiere:

a.159
offre, aliena, procura per mediazione, fabbrica, ripara, modifica, trasforma, esporta in uno Stato Schengen o introduce sul territorio svizzero armi, parti di armi, essenziali o costruite appositamente, accessori di armi, munizioni o elementi di munizioni;

offre, acquista, aliena o procura per mediazione armi da fuoco, loro parti essenziali o costruite appositamente, accessori di armi o munizioni non con-trassegnati conformemente all’articolo 18a o 18b o introdotti illecitamente sul territorio svizzero.
