1 The Swiss authorities have jurisdiction to celebrate a marriage if one of the prospective spouses is domiciled in Switzerland or has Swiss citizenship.24
2 Foreign prospective spouses without Swiss domicile may also be authorised by the competent authority to marry in Switzerland, if the marriage is recognised in the state of domicile or citizenship of both of the prospective spouses.25
3 Such authorisation may not be denied on the sole ground that a divorce granted or recognised in Switzerland is not recognised abroad.

2 Gli sposi stranieri non domiciliati in Svizzera possono nondimeno essere autorizzati dall’autorità competente a contrarre matrimonio in Svizzera se il medesimo vien riconosciuto nello Stato di domicilio o di origine di ambedue.
3 L’autorizzazione non può essere rifiutata per il solo motivo che un divorzio pronunciato o riconosciuto in Svizzera non sarebbe riconosciuto all’estero.
