Art. 3 Registration

1 Data files (Art. 11a para. 3 DPA) must be registered with the Federal Data Protection and Information Commissioner (the Commissioner) before their operational use.6 The registration contains the following information:

a.
the name and address of the controller of the data file;
b.
the name and complete designation of the data file;
c.
the person against whom the right of access may be asserted;
d.
the purpose of the data file;
e.
the categories of personal data processed;
f.
the categories of data recipients;
g.
the categories of persons participating in the data file, i.e. third parties who are permitted to enter and modify data in the data file.

2 Each controller of a data file shall update this information on an ongoing basis. …7

Art. 3 Notifica

1 Le collezioni di dati (art. 11a cpv. 3 LPD) sono notificate all’Incaricato federale della protezione dei dati e della trasparenza (Incaricato) prima di essere rese operative.7 La notifica contiene le informazioni seguenti:

a.
nome e indirizzo del detentore della collezione di dati;
b.
nome e denominazione completa della collezione di dati;
c.
persona presso la quale si può far valere il diritto d’accesso;
d.
scopo della collezione di dati;
e.
categorie di dati personali trattati;
f.
categorie di destinatari dei dati;
g.
categorie di partecipanti alla collezione di dati, vale a dire i terzi autorizzati a introdurre dati nella collezione o a procedere a mutamenti.

2 Ogni detentore di una collezione di dati tiene aggiornate le informazioni. ...8
