Art. 77c Application for destruction of the goods

1 When making an application under Article 76 paragraph 1, the applicant may submit a written request for the FOCBS to destroy the goods.

2 If an application for destruction is made, the FOCBS shall notify the declarant, holder or owner of the goods accordingly as part of the notification made under Article 77 paragraph 1.

3 The application for destruction does not result in the time limits for obtaining preliminary measures under Article 77 paragraphs 2 and 3 being extended.

Art. 77c Domanda di distruzione della merce

1 Insieme con la domanda di cui all’articolo 76 capoverso 1, il richiedente può chiedere per scritto all’UDSC di distruggere la merce.

2 Se è presentata una domanda di distruzione della merce secondo il capoverso 1, l’UDSC ne avvisa il dichiarante, detentore o proprietario della merce nella comunicazione di cui all’articolo 77 capoverso 1.

3 La domanda di distruzione della merce non implica un prolungamento dei termini per chiedere provvedimenti cautelari secondo l’articolo 77 capoversi 2 e 3.
