Art. 69 Infringement of related rights

¹ On the complaint of the person whose rights have been infringed, any person who wilfully and unlawfully commits any of the following acts is liable to a custodial sentence not exceeding one year or a monetary penalty:⁷⁰

a.: broadcasts the performance of a work by radio, television or similar means, including by wire;
b.: fixes a performance of a work on blank media;
c.: offers, transfers or otherwise distributes copies of a performance of a work;
d.: retransmits a broadcast performance of a work by means of technical equipment, the operator of which is not the original broadcasting organisation;
e.⁷¹: makes a performance of a work made available, a broadcast performance of a work or a retransmitted performance of a work perceptible;
e^bis.⁷²: uses a performance of a work under a false name or under a name other than the artist name designated by the performer;
e^ter.⁷³: makes a performance of a work, a phonogram or audio-visual fixation or a broadcast available through any kind of medium in such a way that persons may access them from a place and at a time individually chosen by them;
f.: reproduces a phonogram or audio-visual fixation and offers, transfers or otherwise distributes the reproductions;
g.: retransmits a broadcast;
h.: fixes a broadcast on blank media;
i.: reproduces a broadcast fixed on blank media or distributes copies of such reproductions;
k.⁷⁴: refuses to notify the responsible authority concerned of the origin and quantity of the carriers of a performance protected under Articles 33, 36 or 37 in his possession that have been unlawfully manufactured or placed on the market, or to name the recipients and disclose the extent of any distribution to commercial and industrial customers.

² Any person who has committed any act mentioned in paragraph 1 for commercial gain shall be prosecuted ex officio. The penalty is a custodial sentence not exceeding five years or a monetary penalty. The custodial sentence must be combined with a monetary penalty.⁷⁵

Art. 69 Lesione di diritti di protezione affini

¹ A querela della parte lesa, è punito con una pena detentiva fino a un anno o con una pena pecuniaria chiunque intenzionalmente e illecitamente:⁷⁰

a.: diffonde la prestazione di un artista interprete (prestazione) per radio, televisione o procedimenti analoghi, anche mediante circuiti;
b.: registra una prestazione su supporti audio o audiovisivi o su un supporto di dati;
c.: offre al pubblico, aliena o mette altrimenti in circolazione esemplari riprodotti di una prestazione;
d.: ritrasmette la prestazione con impianti tecnici il cui titolare non è l’organismo di diffusione d’origine;
e.⁷¹: fa vedere o udire una prestazione messa a disposizione, diffusa o ritrasmessa;
e^bis.⁷²: utilizza una prestazione sotto falso nome o sotto un nome diverso dal nome d’arte scelto dall’artista interprete;
e^ter.⁷³: mette a disposizione mediante un procedimento qualsiasi una prestazione, un supporto audio o audiovisivo o un’emissione in modo tale che chiunque possa accedervi dal luogo e nel momento di sua scelta;
f.: riproduce un supporto audio o audiovisivo o offre al pubblico, aliena o mette altrimenti in circolazione gli esemplari riprodotti;
g.: ritrasmette un’emissione;
h.: registra un’emissione su supporti audio o audiovisivi o su un supporto di dati;
i.: riproduce un’emissione registrata su un supporto audio o audiovisivo o su un supporto di dati o mette altrimenti in circolazione tali esemplari riprodotti;
k.⁷⁴: rifiuta d’indicare all’autorità competente la provenienza e la quantità dei supporti in suo possesso sui quali è registrata una prestazione protetta ai sensi degli articoli 33, 36 o 37, illecitamente fabbricati o immessi sul mercato, nonché i destinatari e l’entità delle loro ulteriori forniture ad acquirenti commerciali.

² Se l’autore dell’infrazione ha agito per mestiere, si procede d’ufficio. La pena è una pena detentiva fino a cinque anni o una pena pecuniaria. Con la pena detentiva è cumulata una pena pecuniaria.⁷⁵
