Art. 51

1 Where it may reasonably be expected, the users of works must provide the collective rights management organisations with all the necessary information for the determination and application of the tariffs and for distributing the proceeds in a form that corresponds to the state of the art and allows for automatic data processing.52

1bis Collective rights management organisations are entitled to exchange information received under this Article with one another, insofar as this is necessary for them to carry out their activities.53

2 The collective rights management organisations are obliged to preserve trade secrets.

Art. 51

1 Nella misura in cui sia ragionevolmente esigibile, gli utenti d’opere devono fornire alle società di gestione, in un formato conforme allo stato della tecnica e che consenta un trattamento automatico dei dati, le informazioni di cui necessitano per fissare e applicare le tariffe nonché per ripartire il prodotto della gestione.52

1bis Le società di gestione possono scambiarsi le informazioni ottenute in applicazione del presente articolo per quanto sia necessario all’esercizio delle loro attività.53

2 Le società di gestione sono tenute al segreto commerciale.
