1 The recipient is entitled to reimbursement of necessary and useful expenditures, although where the unjust enrichment was received in bad faith, the reimbursement of useful expenditures must not exceed the amount of added value as at the time of restitution.
2 He is not entitled to any compensation for other expenditures, but where no such compensation is offered to him, he may, before returning the property, remove anything he has added to it provided this is possible without damaging it.
1 Chi si è indebitamente arricchito ha diritto alla rifusione delle spese necessarie ed utili da lui incontrate; di quest’ultime però, se all’atto del ricevimento non era in buona fede, solo fino a concorrenza del maggior valore tuttora sussistente al momento della restituzione.
2 Egli non può pretendere indennità per altre spese, ma ha diritto, nel caso che l’indennità non gli sia offerta, di togliere, prima di restituire la cosa, ciò che vi avesse aggiunto, in quanto si possa fare senza danneggiarla.
