Art. 567 V. Transactions and liability in tort

1 The partnership acquires rights and assumes obligations by the transactions concluded in its name by any partner authorised to represent it.

2 For such effect to occur, it is sufficient that the intention to act on behalf of the partnership can be inferred from the circumstances.

3 The partnership is liable in damages for any tort committed by a partner in the exercise of his partnership function.

Art. 567 V. Negozi giuridici e responsabilità per atti illeciti

1 La società acquista diritti e si vincola per i negozi giuridici fatti in suo nome da uno dei soci autorizzati a rappresentarla.

2 Basta che l’intenzione di fare il negozio in nome della società risulti dalle circostanze.

3 La società risponde del danno cagionato da un socio con atti illeciti commessi nell’esercizio d’incombenze sociali.
