1 In the case of divorce, separation, annulment of marriage or separation of property by court order, agreements varying the statutory share of the surplus are valid only if the marital property agreement expressly so provides.
2 This also applies on the dissolution of the marital property regime by death when divorce proceedings are pending if that results in the surviving spouse losing his or her right to claim the statutory entitlement.230
