Art. 148a

¹ If the scientific information is insufficient to fully assess the risks pertaining to aids to production or plant material that may carry particularly dangerous harmful organisms, preventive measures may be taken if:

a.: it is suspected that the aids to production or plant material may have undesirable side-effects on the health of humans, animals, plants or the environment; and
b.: it is highly likely that such side-effects will occur or that the consequences thereof could be far-reaching.

² Preventive measures must be re-examined and modified within an appropriate time-frame in accordance with the latest scientific findings.

³ With regard to preventive measures, the Federal Council may in particular:

a.: restrict, issue conditions for or ban the importing, circulation and use of aids to production;
b.: restrict, issue conditions for or ban the importing and circulation of plant material and goods that may carry particularly dangerous harmful organisms.

Art. 148a

¹ Des mesures de précaution peuvent être prises alors même que les informations scientifiques sont insuffisantes pour une évaluation complète du risque lié à un moyen de production ou à un matériel végétal susceptible d’être porteur d’organismes nuisibles particulièrement dangereux:

a.: s’il semble plausible que ce moyen de production ou ce matériel végétal puisse avoir des effets secondaires intolérables pour la santé de l’être humain, des animaux et des végétaux ou pour l’environnement, et
b.: si la probabilité de tels effets paraît considérable ou que les conséquences peuvent être graves.

² Les mesures de précaution doivent être réévaluées et adaptées dans un délai raisonnable à la lumière des nouveaux résultats scientifiques.

3 Le Conseil fédéral peut notamment, à titre de précaution:

a.: restreindre, lier à des conditions particulières ou interdire l’importation, la mise en circulation et l’utilisation de moyens de production;
b.: restreindre, lier à des conditions particulières ou interdire l’importation et la mise en circulation de matériel végétal et d’objets pouvant être porteurs d’organismes nuisibles particulièrement dangereux.
